NSW Real Estate Laws

Questions: 1.Prepare a learning plan to bring Ethan up to the appropriate knowledge and skill level regarding retail and commercial leasing and management sector. 2.Prepare a learning delivery strategy for Ethans workplace focussing on the development of the retail and commercial leasing and management operations at Evansdale Realty. 3.Develop a suitable way to check on progress and then to evaluate the workplace learning. Answers: Task 1 Ethan requires developing appropriate skills with regard to the retail and commercial leases management sector. The following steps are the learning plan in order to assist Ethan in developing proper knowledge of this area. Step 1: Entire knowledge of the Retail Leases Act 1994 (NSW) (Act) that governs the laws regarding leases in New South Wakes. It gives detailed knowledge of the negotiations of the lease terms, drafting of leases and arrangement of the lease registration (Cahill, 2012). Step 2: Proper understanding of the differences between a retail lease and a non retail commercial lease is extremely essential for Ethan. Hence it is required for Ethan to be guided on the sections of 9, 11, 14 and 16 of the Act (Cahill, 2013). Step 3: Differences between security deposits and bank guarantees with regard to the real estate legislations also needs to be made clear to Ethan (Cahill, 2012). Step 4: Ethan needs to be briefed of the kind of disputes that arise in the case of non- retail commercial leases so that it gradually becomes efficient to tackles issues. Step 5: All details from the legislation about market rent review also needs to be specified to Ethan. Step 6: Ethan also needs to be reviewed and briefed about the latest reforms in relation to the Retail Leases Act of 1994. Task 2 An appropriate learning delivery strategy for Ethan would focus on the following things so that the ongoing development at the retail and commercial leasing management operations at the Evansdale Realty is enhanced. Evan must primarily comply with the necessary fiduciary obligations. Evan is required to act honestly, fairly and professionally with all the client parties in any transaction. Evan under no circumstances must mislead or deceive any of the parties in the negotiations or transactions. Evan should not engage in high pressure tactics or any other harsh or unconscionable conduct. Evan should not disclose any confidential information that he obtains while acting for the client until the client authorizes such disclosure or the law compels him to do so (Cahill, 2013). Evan should not accept any such appointment that the interests of the agent come in conflict with the interest of the client. Evan should also take appropriate steps in order to ensure that all licensees and other registered people are complying with the legal regulations. Task 3 After making Ethan learn according to the learning techniques and delivering in accordance to the proper strategies, it is essential that this progress is assessed properly. The most suitable manner in order to check on Ethans progress is by developing a evaluation strategy appropriate for the purpose. Accordingly, Ethan has to report for all the work done by him for the first few months to the appropriate senior staff. All the work done by Ethan shall be then checked by the superior authorities and whether Ethans work was as required will depend on the feedback from the seniors who were given the assessment.
